Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BookInfluencers mobile application, website at bookinfluencers.app, and all related features and services (collectively, the "Services") operated by BookInfluencers ("we", "us", "our").
By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By registering, you represent that you meet this requirement. If you use the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" includes that entity.
2. The Platform
BookInfluencers is an influencer marketing platform that connects brands with influencers/creators. The Services allow:
- Brands to create campaigns, search and book influencers, and track campaign performance.
- Influencers to create creator profiles, apply to campaigns, accept or decline deal requests, and receive payouts.
- Both parties to communicate, manage deliverables, and handle transactions within the app.
We may modify, suspend, or discontinue features of the Services with reasonable notice where practicable.
3. Accounts
You must create an account to access core features. You agree to:
- Provide accurate, current, and complete information during registration.
- Keep your credentials confidential and not share them with others.
- Notify us immediately at info@bookinfluencers.app of any unauthorised access to your account.
- Be responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the platform or other users.
4. Acceptable Use
You agree not to:
- Violate any applicable law, regulation, or third-party rights.
- Provide false information about your follower counts, reach, or identity.
- Create fake campaigns, fraudulent deals, or misleading brand profiles.
- Use bots, automated tools, or fake accounts to inflate metrics or generate fraudulent activity.
- Harass, abuse, threaten, or intimidate other users.
- Upload malware, viruses, or any harmful content.
- Attempt to reverse engineer, decompile, or extract source code from our apps.
- Use the Services to build a competing platform using our proprietary data or features.
- Circumvent any platform fee or payment obligation.
5. Creator Responsibilities
If you register as an influencer or creator, you agree to:
- Only accept campaigns you genuinely intend to complete.
- Deliver content that meets the agreed brief, format, and deadline.
- Comply with applicable advertising disclosure laws (e.g. FTC guidelines, EU Directive on Unfair Commercial Practices), including clearly labelling sponsored content as "#ad" or "#sponsored".
- Not accept a campaign and fail to deliver without communicating a valid reason in a timely manner.
- Provide accurate analytics data when requested by brands or by the platform.
6. Brand Responsibilities
If you register as a brand, you agree to:
- Create campaigns with accurate descriptions, realistic deliverables, and fair budgets.
- Communicate clearly and promptly with creators during the campaign.
- Approve or reject submitted content within the agreed timeframe.
- Pay agreed fees on time and not attempt to withhold payment for reasons outside the agreed deliverables.
- Ensure your products and services comply with applicable laws and platform guidelines.
7. Payments and Fees
Transactions between brands and influencers are facilitated through the BookInfluencers platform.
- Escrow: Funds paid by brands are held in escrow until the agreed deliverable is submitted and approved.
- Payouts: Influencer payouts are processed after brand approval of the delivered content. Payout timing depends on your selected payment method and may vary.
- Platform fee: BookInfluencers may charge a service fee on transactions, which will be clearly disclosed before you confirm a deal.
- Taxes: You are responsible for any taxes applicable to your income from the platform. BookInfluencers may issue tax documentation where required by law.
- Refunds: Fees are generally non-refundable except where a creator fails to deliver agreed content or where required by applicable consumer protection law.
8. Third-Party Platform Integrations
The Services integrate with third-party APIs. Your use of these integrations is also subject to the third party's own terms and policies:
- Meta Platform Terms (Facebook & Instagram)
- YouTube API Terms of Service and Google Privacy Policy
- TikTok Terms of Service
- Apple EULA (for App Store users)
We are not responsible for the actions, content, or policies of third-party platforms. Issues with your social media accounts must be resolved directly with the respective platform.
9. Content and Intellectual Property
9.1 Your content
You retain ownership of content you create and submit. By uploading content to BookInfluencers, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and use that content solely to operate the Services, including showing your profile to brands.
9.2 Campaign content
Unless the campaign contract specifies otherwise, creators retain copyright in content they produce. Brands receive a licence to use the content for the agreed promotional purposes. Any additional usage rights (e.g. paid media) must be negotiated and agreed separately.
9.3 Our intellectual property
BookInfluencers and its licensors own all rights to the platform, including the app, website, branding, and underlying technology. These Terms grant you no ownership or sublicence rights in our IP.
9.4 Prohibited content
You may not submit content that is illegal, defamatory, pornographic, violent, discriminatory, misleading, or that infringes the intellectual property rights of others.
10. Disclaimers
The Services are provided "as is" and "as available" to the fullest extent permitted by law. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that results from campaigns will meet your expectations.
BookInfluencers is a marketplace and is not a party to individual deals between brands and influencers beyond facilitating payment escrow. We are not responsible for the quality, timeliness, or outcome of any campaign.
11. Limitation of Liability
To the maximum extent permitted by applicable law, BookInfluencers is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising from your use of the Services.
Our aggregate liability for any claim arising under these Terms is limited to the greater of: (a) the total fees you paid us in the 12 months preceding the claim, or (b) €100.
Mandatory legal protections (including EU consumer rights and liability for gross negligence or intent) remain unaffected.
12. Indemnification
You agree to defend and indemnify BookInfluencers, its affiliates, and employees against claims, damages, and costs (including reasonable legal fees) arising from: (a) your content; (b) your violation of these Terms; (c) your breach of applicable law; or (d) disputes between you and another user.
13. Dispute Resolution Between Users
If a dispute arises between a brand and an influencer regarding a campaign (e.g. non-delivery, non-payment, content disputes), both parties agree to first attempt to resolve the matter through our in-app dispute resolution process. We will make reasonable efforts to mediate, but our decisions are not legally binding. Unresolved disputes may be pursued through the courts set out in Section 14.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of Germany, excluding conflict-of-law rules. Mandatory consumer protections applicable in your country of residence are not affected. For EEA consumers, disputes may also be resolved through the EU Online Dispute Resolution platform.
15. Termination
You may close your account at any time via the app settings or by contacting us. We may suspend or terminate your access if you breach these Terms, create legal risk, or if we are required to do so by law. Upon termination, your right to use the Services ends. Provisions that by their nature survive termination (including Sections 9, 10, 11, 12, and 14) will remain in effect.
16. Changes to These Terms
We may modify these Terms by posting an updated version with a new effective date. For material changes, we will notify you through the app or by email at least 14 days before they take effect where required by law. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
17. Miscellaneous
- If any provision is held unenforceable, the remainder of these Terms stays in full effect.
- Our failure to enforce any provision is not a waiver of our right to do so in the future.
- You may not transfer your rights under these Terms without our written consent.
- These Terms, together with our Privacy Policy, constitute the entire agreement between you and BookInfluencers regarding the Services.
